By accessing or using our website mobile application, WhatsApp ordering channel, or any other digital platform operated by Vibini Farms Private Limited ("Vibini," "we," "us," or "our"), and by placing an order with us, you agree to be bound by the following Terms & Conditions. Please read them carefully before using our services.

1. Acceptance of Terms

By accessing this Platform, creating an account, placing an order, or making a payment, you agree to comply with and be legally bound by these Terms & Conditions. If you do not agree with any part of these terms, please do not use our services. These Terms constitute a legally binding agreement between you and Vibini Farms Private Limited.

2. About Vibini

Vibini Farms Private Limited, a brand of Prithvi Farms, is a Pune-based fresh produce company that sources, stores, and delivers fresh fruits, exotic produce, and frozen berry products to consumers and businesses. Vibini operates solar-powered cold storage facilities, maintains a CNG delivery fleet, and sources produce through a combination of direct farm partnerships and trusted suppliers and importers.

3. Eligibility

You must be at least 18 years of age and capable of entering into a legally binding agreement to use this Platform and place orders. By using the Platform, you represent and warrant that you meet these eligibility requirements.

4. Products and Availability

All fresh fruits, exotic produce, frozen berry products, and other items listed on the Platform are subject to availability based on seasonal conditions, supply cycles, and market factors. We reserve the right to limit order quantities, modify product listings, or discontinue any item at any time without prior notice.

Product images displayed on the Platform are for illustrative purposes only. Fresh produce is a natural product, and variations in size, colour, shape, taste, and shelf life are inherent and expected. Actual product appearance and packaging may differ from the images shown.

We do not claim that any product is certified organic unless explicitly stated on the product packaging or individual product listing. All product descriptions and nutritional information are provided in good faith and to the best of our knowledge.

5. Account Registration

To place orders on the Platform, you may be required to create an account by providing your name, phone number, email address, and delivery address. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account.

6. Order Placement and Confirmation

When you place an order on the Platform, it constitutes an offer to purchase the selected products. An order is confirmed only when you receive an order confirmation from us via the Platform, WhatsApp, SMS, or email. We reserve the right to accept or reject any order at our sole discretion.

Please ensure that all delivery details, including your full name, complete delivery address, and contact number, are accurate at the time of placing your order. Vibini shall not be responsible for failed or delayed deliveries arising from incorrect or incomplete information provided by you.

7. Pricing and Payment

All prices displayed on the Platform are in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise. Prices are subject to change without prior notice due to seasonal variations, supply conditions, and market factors. We reserve the right to correct any pricing errors and to cancel orders placed at incorrect prices.

7.1 Minimum Order Value

The minimum order value for direct-to-consumer (B2C) orders is Rs 200. Orders below ₹200 cannot be processed. For business-to-business (B2B) orders, the minimum order value is Rs 3,000.

7.2 Payment Methods

Payments can be made via our integrated payment gateway (such as Razorpay or similar providers), UPI, net banking, debit card, credit card, or cash on delivery where available. We do not store your card, UPI, or banking credentials on our servers. All online transactions are processed securely through PCI-DSS compliant third-party payment processors.

7.3Advance Payment

For custom fruit hampers, bulk orders, and certain seasonal or limited-availability products, 100% advance payment may be required at the time of order confirmation. No cancellations or refunds are permitted on advance-payment orders once confirmed, except as provided in our Returns and Refunds section.

7.4 Cash on Delivery

We reserve the right to cancel any order in case of non-payment, suspected fraudulent activity, or incorrect order details.

8. Delivery

8.1 Service Area

We currently deliver within Pune and PCMC areas, including but not limited to Aundh, Baner,  Balewadi, Pashan, Wakad, Pimple Nilakh, Pimple Saudagar, Punawale, and surrounding localities. 

8.2 Delivery Charges

A flat delivery charge of INR 60 applies per order on orders below Rs2500. Free shipping is applicable to orders with a total order value of Rs 2,500 or above.

8.3 Delivery Timelines

Vibini offers same-day, next-day, and scheduled delivery options depending on product availability and order time. All delivery timelines are estimates and may vary due to factors beyond our control, including weather conditions, traffic, supply delays, or operational constraints. While we strive to deliver all orders as promptly as possible, we shall not be liable for any delays in delivery.

8.4 Inspection at Delivery

Customers are expected to inspect the products at the time of delivery. Any concerns regarding product quality, quantity, or damage must be reported to our customer support team immediately at the time of delivery or within the timeframe specified in our Returns and Refunds section.

9. Subscription and Loyalty Programme

Vibini may offer subscription-based ordering and a loyalty discount programme. The current loyalty discount structure is as follows: 10% off on your first order; 5% discount on your 5th through 9th orders; 10% discount on your 10th through 14th orders; and 15% discount from your 15th order onwards. This discount structure is subject to change at our discretion, and any changes will be communicated through the Platform or via direct customer communication.

10.Returns and Refunds

Due to the perishable nature of fresh produce, our return and refund policy is limited as follows:

(a) Returns are accepted only at the time of delivery for products that are visibly damaged, spoiled, or materially different from what was ordered.

(b) No returns or refunds are permitted after the delivery has been accepted and the delivery person has departed, except as stated in clause (c) below.

(c) For advance-payment orders, if you discover damaged or defective products, a partial refund or replacement may be issued if the issue is reported to our customer support team with photographic evidence within 24 hours of delivery.

(d) Custom fruit hampers, gift baskets, and made-to-order products are non-refundable and non-cancellable once the order has been confirmed.

(e) Refunds, where approved, will be processed within 7 to 10 business days to the original payment method.

For frozen berry products, returns are accepted only if the product was received in a thawed or compromised condition due to a delivery failure on our part.

11. Cancellation Policy

You may cancel an order before it has been dispatched for delivery by contacting our customer support team. Once an order has been dispatched, cancellation is not possible. For advance-payment orders on custom or seasonal products, cancellations are not permitted after order confirmation.

We reserve the right to cancel any order due to product unavailability, pricing errors, suspected fraud, or non-payment. In such cases, any payment already received will be refunded in full within 7 to 10 business days.

12. User Conduct

You agree not to misuse the Platform in any manner, including but not limited to: placing false, fraudulent, or speculative orders; attempting to gain unauthorised access to any part of the Platform, its servers, or databases; interfering with the proper functioning of the Platform; using automated tools, bots, or scripts to access or scrape the Platform; impersonating another person or entity; or engaging in any activity that violates applicable laws or regulations.

We reserve the right to suspend or terminate your account and refuse service if you are found to be in violation of these terms.

13. Intellectual Property

All content on this Platform, including but not limited to text, graphics, logos, brand elements, product names, taglines (including "pure by nature"), images, videos, and software, is the intellectual property of Vibini Farms Private Limited or its licensors and is protected under applicable intellectual property laws. Unauthorised reproduction, distribution, modification, public display, or commercial use of any content from this Platform is strictly prohibited without prior written consent from Vibini.

14. User-Generated Content

If you submit reviews, feedback, ratings, photographs, or any other content through the Platform, you grant Vibini a non-exclusive, royalty-free, perpetual, and irrevocable licence to use, reproduce, modify, adapt, and display such content for purposes related to our business operations, including marketing and promotional activities. You represent and warrant that any content you submit is your original work, does not infringe on the rights of any third party, and does not contain unlawful, defamatory, or obscene material.

15. Third-Party Services and Links

The Platform may integrate with or contain links to third-party services, including payment gateways, delivery tracking tools, and external websites. These third-party services are governed by their own terms of use and privacy policies. Vibini does not endorse, control, or assume responsibility for the content, practices, or availability of any third-party services. Your interaction with third-party services is at your own risk.

16. Limitation of Liability

To the fullest extent permitted by applicable law, Vibini Farms Private Limited, its founders, directors, employees, and partners shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or in connection with your use of the Platform or our services, including but not limited to: loss of data, loss of profits, business interruption, personal injury, or any claims related to the quality, freshness, suitability, or fitness of products delivered.

In the event of any error, technical failure, payment processing issue, or unexpected delay, our maximum liability shall be limited to refunding the payment made for the affected order or replacing the product, at our sole discretion.

17. Indemnification

You agree to indemnify, defend, and hold harmless Vibini Farms Private Limited, its founders, directors, employees, agents, and partners from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising out of or related to: your use of the Platform, your violation of these Terms, your violation of any applicable law, or your infringement of any rights of a third party.

18. Force Majeure

Vibini shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay arises from circumstances beyond its reasonable control, including but not limited to natural disasters, pandemics, epidemics, government actions or restrictions, strikes, supply chain disruptions, transportation failures, extreme weather events, or utility outages.

19. Severability

If any provision of these Terms & Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

20. Entire Agreement

These Terms & Conditions, together with our Privacy Policy, Disclaimer, and any other policies referenced herein, constitute the entire agreement between you and Vibini Farms Private Limited with respect to your use of the Platform. These Terms supersede any prior agreements, understandings, or representations, whether written or oral.

21. Governing Law and Jurisdiction

These Terms & Conditions are governed by and construed in accordance with the laws of India, including the Information Technology Act, 2000, the Consumer Protection Act, 2019, and the Digital Personal Data Protection Act, 2023. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra, India.

22. Changes to These Terms

We may update or modify these Terms & Conditions at any time without prior notice. The updated Terms will be posted on the Platform with a revised effective date. Your continued use of the Platform after the posting of any changes constitutes your acceptance of the updated Terms. We encourage you to review this page periodically.

23. Grievance Redressal

In accordance with the Information Technology Act, 2000, the Consumer Protection Act, 2019, and the rules made thereunder, the details of the Grievance Officer are as follows:
